1. Scope
1.1. The business relationship between the seller of the online shop www.shop.kraeuterdrogerie.at, owner: Zsuzsánna Tamás-Szóra, 1080 Vienna, Kochgasse 34, telephone: +43 1 4054522 (hereinafter "Seller") and the customer (hereinafter "Customer") is exclusively governed by the following General Terms and Conditions in the version valid at the time of the order.

1.3. Deviating terms and conditions of the customer will not be accepted.
2. Offers and service descriptions
2.1. The products presented in the online shop www.shop.kraeuterdrogerie.at are offered for sale by the seller. Due to different monitor settings, the color representation of the items offered may vary slightly for technical reasons.
2.2. All offers are valid according to the quantity specified, unless otherwise stated for the products. Errors excepted.
3. Ordering process and conclusion of contract
3.1. The Customer may select products from the Seller's range without obligation and collect them in a so-called shopping cart by clicking on the [ADD TO CART] button.
3.2 If all desired items are in the “Shopping Cart”, the customer then confirms this within the shopping cart by clicking the [CONTINUE TO CHECKOUT] button.
3.3. At the CHECKOUT stage, the customer enters their data in the designated fields. They select their preferred shipping and payment options. The "Confirmation of our Terms and Conditions" checkbox must be activated by the customer to continue the order process.
3.4. Before submitting the order, an overview of the ordered goods is displayed. The customer has the option of reviewing and changing the previously entered data, or canceling the order entirely.
3.5. By clicking the [ORDER WITH PAYMENT] button, the customer submits a binding offer to purchase the goods in the shopping cart. The seller will then send the customer a confirmation of receipt by email, which details the customer's order and which the customer can print out (order confirmation).
3.6. In the event of delivery impediments or other circumstances that would prevent the fulfillment of the contract, the customer will be informed immediately by email.
4. Prices and shipping costs
4.1. All prices listed on the Seller's website include the applicable statutory value-added tax. Subject to price changes and errors.
4.2. In addition to the stated prices, the Seller shall charge shipping costs for delivery. The shipping costs will be clearly communicated to the Buyer during the ordering process.
5. Terms of payment and retention of title
5.1. The customer can choose from the available payment methods during and before completing the order process.
5.2. For all payment methods, payment must be made in advance without deduction.
5.3. If third parties are commissioned to process payments, e.g. Paypal, their general terms and conditions apply.
5.4. The Seller retains ownership of the delivered goods until the Customer has paid the purchase price, including shipping costs, in full.
5.5. If payment is not received by the Seller within 14 calendar days of the order confirmation being sent, even after renewed requests, the Seller shall withdraw from the contract, with the result that the order is void and the Seller is no longer obligated to deliver. The order shall then be deemed completed without further consequences for both the Customer and the Seller.
5.6. For deliveries to countries outside the EU, customs duties and import sales tax may apply, which must be paid by the customer to the customs authorities upon receipt of the shipment. These costs are in addition to the purchase price and shipping costs and are beyond the seller's control.
6. Warranty and guarantee for material defects
6.1. The warranty is determined in accordance with statutory provisions.
6.2. A guarantee for goods delivered by the Seller shall only exist if this has been expressly stated.
7. Right of withdrawal/Cancellation policy
7.1. The customer may withdraw from the concluded contract within 14 days of receipt of the goods by sending a written declaration of withdrawal without stating reasons. To exercise the right of withdrawal, the customer must inform the seller of their decision to withdraw from the contract by means of an unambiguous written declaration (by letter or email). The declaration of withdrawal must be sent to the following address: Die Kräuterdrogerie, 1080 Vienna, Kochgasse 34, (or by email to: office@kraeuterdrogerie.at ). It is sufficient to send the declaration of withdrawal within this period. The date of the postal receipt or the time of the email dispatch is decisive in this case.
7.2. In this case, the customer is obligated to return the goods immediately and must provide evidence of this. The return shipping costs (postage) are to be borne by the customer.
7.3. If the goods have been used and/or damaged by the Customer, the Customer shall pay the Seller a reasonable fee for the use, including reasonable compensation for the damages incurred (up to a maximum of the value of the goods).
7.4. The customer may also exercise their right of withdrawal by simply returning the goods to the seller within 14 days of receipt without providing a written declaration of withdrawal. In this case, the timely dispatch of the goods is sufficient to meet the deadline. The prerequisite for exercising the right of withdrawal by simply returning the goods is that the goods are not damaged or used, and that the return is sufficiently postage paid. The risk of return shipment and the proof of such shipment rest with the customer.
7.5. In the event of a customer's withdrawal (by express declaration or simply by returning the goods), the seller will immediately refund the purchase price already paid. Shipping costs are non-refundable.
8. Information on the exclusion of the right of withdrawal
8.1. The right of withdrawal does not apply to the delivery of goods that were manufactured according to customer specifications or are clearly tailored to personal needs, e.g. personalized goods.
9. Returns
9.1 Customers are asked to notify the seller before returning the goods (by email to office@kraeuterdrogerie.at or by phone at +43 1 4054522) to announce the return. This will allow the seller to allocate the products as quickly as possible.
9.2. Customers are requested to return the goods to the Seller as a prepaid parcel and to retain the shipping receipt.
9.3. If possible, the goods should be returned to the Seller in their original packaging with all accessories. If the original packaging is no longer in the Buyer's possession, other suitable packaging should be used to ensure adequate protection against transport damage and to avoid any claims for damages resulting from inadequate packaging.
10. Storage of the contract text
10.1. The Seller saves the contract text of the order. The General Terms and Conditions are available online.
11. Data protection
11.1. The Seller processes the Customer's personal data for specific purposes and in accordance with the legal provisions of the EU General Data Protection Regulation (GDPR).
11.2. The personal data provided for the purpose of ordering goods (such as name, email address, address, telephone number, payment details) will be used by the Seller to fulfill and process the contract. This data will be treated confidentially and will not be shared with third parties not involved in the ordering, delivery, and payment processes.
11.3. The customer has the right, upon request, to receive information free of charge about the personal data stored about him or her by the seller. In addition, the customer has the right to correct inaccurate data, to block, and to delete his or her personal data, provided that no statutory retention period precludes this.
12. Place of jurisdiction, applicable law, contract language
12.1. The place of jurisdiction and performance shall be the registered office of the Seller if the Customer is a merchant, a legal entity under public law or a special fund under public law.
12.2. The contract language is German.
